General Terms & Conditions Philippe Sail
These general terms apply on your purchase and usage of the website www.philippesail.com, registered under Philippe Sail AB. The terms constitute an agreement between you and Philippe Sail, swedish company registration 559221-0735, Topasgatan 19, 421 48 Västra Frölunda (from now on named Philippe Sail). By making a purchase and using this web site, you agree to these terms and conditions. Therefore, please read carefully the terms and conditions prior to using the website. At the time of purchase, the terms of purchase will be sent to the specified e-mail address that you have stated in the order. Philippe Sail AB do not under any circumstances conclude agreements with minors (under 18 years). Not even with the parental approval.
After an order has been placed an order confirmation is sent to the given e-mail address. Therefore, it is important that correct e-mail address is given. Further it is recommended to save the confirmation in case contact is needed with our customer services. The order confirmation is also a receipt of purchase made.
You can pay by bank, credit card by Paypal. Philippe Sail does not handle any bank or credit card details. Please note that Paypal can make a credit check and if needed with a credit check company. These checks are never shared with a third party which means that it is never shown with other companies. This does not affect the credit value of a customer. If Paypal has done a check a customer will get according to law a copy of this check. Philippe Sail has a SSL certificate. SSL make sure that all data sent through the web server and website remains private and encrypted.
Paying with card
Paying with bank or credit card safe online. Paypal is administrating your payment safely encrypted and in accordance with strict bank standards. Your card details are sent directly through to your bank and cannot be accessed by anyone else but your bank. There are no extra charges when paying with bank card. Card payments dealt with Paypal are PCI-DSS certified which means that they follow the Payment Card Industry Data Security Standard.
Prices & Taxes
All prices shown on the Philippe Sail website, www.philippesail.com, are including VAT, in accordance with the applicable legislation. In case an order will be shipped to a delivery address outside the EU, please note that the VAT is removed at the checkout or earlier depending on which country the product will be delivered to. Please note that in case of an order is shipped to a delivery address outside the EU, you may be subject to import duties and taxes, which are collected when the shipment reaches your delivery address. You will be responsible for payment of such import duties and taxes. It should be noted that Philippe Sail has no control over these charges and, since these charges are different for different countries, Philippe Sail cannot predict their amount. Philippe Sail advises you to contact your local customs office for further information.
Philippe Sail has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the product. The pictures may differ depending on the color settings in your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.
Orders made in another person's name without the person’s consent, will be reported to the authorities. Philippe Sail holds the right to change prices, correct incorrect prices on all orders as well as final sales. If a price is obviously incorrect, this may compel Philippe Sail to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.
Consumers have the right to return the order within 30 days from receiving the order. The right applies only in the case that the product and its original packaging can be returned in the same condition as when received. If consumers use their right to send back an order they should contact Philippe Sail customer service in order to get an address to send the goods to. Return shipping is paid by consumer. If an item is damaged during transport, Philippe Sail should be contacted within 14 days for information about compensation.
Delivery and Cancellations
Philippe Sail ships worldwide. Deliveries are made in cooperation with the postal services and their partners. You have the right to cancel purchases and return delivered goods by contacting Philippe Sail’s customer service or using the contact form on Philippe Sail´s website within 30 days from receiving the goods, provided the goods are unpacked and in the same condition as when you received them. However, the customer is responsible for the risk for transporting the returned goods back to Philippe Sail.
In cases, you as a customer believe that the delivery is delayed in such a way that you no longer wish to fulfill the order, it is your responsibility to cancel the order. In cases where the order has been dispatched, the customer is required to receive the order. Cancellation is not valid until the customer has confirmed with Philippe Sail by email. If a product has been discontinued Philippe Sail has the right to cancel the purchase and refund the paid amount to the customer. Philippe Sail will notify the customer of a replacement or equivalent products if available.
Warranty term: One year from the date of purchase. This warranty covers manufacturing defects on the bracelet itself and the anchor. Other parts than the above are not covered by this warranty. To have replacement covered under this warranty performed, please use our contact form on the "contact us" page. In the e-mail you need to specify your name, address, order number and a detailed description of the issue. Finally, write ‘reclaim of purchase’ as subject of the e-mail or letter. Return shipping is paid by Philippe Sail. If Philippe Sail cannot find any defects described above, the product will be sent back to the customer.
Note that repair/replacements will be charged in the following cases, even during the warranty term.
- Failure or damage caused by improper use or carelessness (knocks, dents, crushing, broken crystal, etc.)
- Failure or damage caused by unjustifiable repair or modification
- Failure or damage caused by fire or water, or a natural disaster such as for example an earthquake
- Esthetical changes that occur during normal wear and tear and aging (minor scratches, etc.; on the case and/or crystal, alteration of the colour on the wristband and the peeling of the plating, discoloring of the flag)
- In case the retail store and the purchase date are not indicated on the warranty, or if this information has been rewritten.
This warranty warrants that you can receive free replacement in accordance with the terms set forth herein and within the specified term, and shall not restrict any lawful right of the Customer.
Philippe Sail is not responsible for any damages on clothes, furniture, toys or any other items which might have been damaged while wearing Philippe Sail items.
It is important that you as a customer carefully check your products when you receive your shipment in order to verify that the products are correct and not damaged. If your product has been damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact us within 30 days from receiving the product.
Any complaints shall be made to our customer service through our contact form (LÄNK) on the contact page. Please supply the order number and the reason for complaint and we will get back to you shortly. Same applies for returns. Defective products returned to Philippe Sail should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. Philippe Sail has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund. In the case that a returned product has no errors or faults, Philippe Sail will send the product back to the customer.
It is also possible to write a letter to Philippe Sail at: Protectors of Sweden, Topasgatan 19, 421 48 Västra Frölunda, Sweden. Please make sure to include name, order and short explanation to the complaint. We will thereafter contact you with further instructions on how to return damaged goods.
Customer has 3 years right to claim faulty goods however customer must report the fault within reasonable time. Philippe Sail follows Swedish local authority´s regulations (Konsumentverkets regler) regarding claims where 2 months is considered as a reasonable time to inform about a damage.
If there is a dispute Philippe Sail follows the Swedish ”Allmänna reklamationsnämndens rekommendationer”.
Further on customers have also right to use the European commission online platform for solving disputes, so called ODR. This is a new platform which the EU commission has launched where an unsatisfied customer that has purchased an item or service within EU can get help and advice instead of going to court. ODR stands for Online Dispute Resolution which refers to disputes on the Internet.
Philippe Sail shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new / amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.
Intellectual Property Rights
All intellectual property rights, such as trademarks and copyright, on the website and in the material published on it are owned by Philippe Sail or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Philippe Sail.
The Philippe Sail website may include user generated content, for example social media applications. Philippe Sail does not claim any ownership in rights in such content (images, photos and videos etc.) and take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise is offended by such content, please contact our customer service.
All products remain in Philippe Sail property until full payment is made.
All frauds are reported to the authorities and Philippe Sail reserves the right to cancel the purchase if any suspicion is raised.
